This page (together with the documents referred to on it) tells you the terms of use on which you may make use of our website at www.quizfortune.com (“our site”), whether as a guest or a registered user. Please read these Terms of Use carefully before you start to use our site. By using our site, playing the Games (defined below) or registering as a “Member”, you indicate that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using our site.
INFORMATION ABOUT US
www.quizfortune.com is a site operated by QuizFortune Limited. We are registered in Northern Ireland under company number NI069366 and have our registered office at Unit 5L, Weavers Court, Linfield Road, Belfast, BT12 5GH
Our site contains various 'skill' and 'ability' based general awareness and knowledge quiz games (“Games”). Thus, www.quizfortune.com is a “game of skill‟ website and not a gambling, gaming, lottery or a game of chance website and is, therefore, legal under the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985.
ACCESSING OUR SITE
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use.

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms of Use, and that they comply with them.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE
We process information about you in accordance with our Privacy Policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.
REGISTRATION AND MEMBERSHIP
You do not have to be over 18 years old to play free Games on our site. However, to become a Member that can play Games for money (“Member Games”), you must be at least 18 years old, register as a Member and establish an Account with us.
By registering and establishing an Account with us you expressly warrant to us that when playing any of our Member Games that:
- you are at least 18 years of age or, if you are located in Estonia, you are at least 21 years of age;
- you are able to enter into a legally binding agreement with us;
- you will not use the Member Games while you are located in a country, state or jurisdiction that does not allow you to play the Games (if in doubt, you should check before you play any of the Member Games);
- you are not a licensed bookmaker or a bookmaker’s agent, employee of ours or any associated company of ours and that you do not conduct a business of negotiating or receiving bets;
- you are not depositing money that does not belong to you, which has been gained from criminal or other illegal activity or with a credit, debit or charge card that does not belong to you;
- you are not bankrupt;
- you understand that, by playing the Member Games, you may lose money that you may pay to play a Member Game and accept that you are fully responsible for any such loss; and
- you will not use our site for any purpose that is unlawful or prohibited by these Terms of Use.
If you register as a Member, the Member Games will be made immediately available for your use. As a result you will not have the right to cancel these Terms of Use or to any refund of monies you pay once you have started to play a Member Game and the applicability and enforceability of these terms and conditions shall not be affected by any “cooling-off” period once you have played a Member Game.
You undertake to register as a Member using only accurate and current information about yourself including your age, full name and surname, place of residence and a valid email address.
You agree to only register one online Account and / or one mobile Account with us.
You will not allow anyone else to use your login details or give them to anyone else. If you do, you accept full responsibility for the consequences of this and agree to fully indemnify and hold us harmless from any damage or harm that may result.
GAMES WINNERS AND PRIZES
The number of Members participating in a Game and their relative skills determine the result of all Games.
The prize amount of all Member Games will be disclosed at the outset of each Member Game, except in cash progressive jackpot Member Games where the cash prize will be dependent upon the number of participants in the Member Game. The indicated cash prize will be the total prize fund that will be distributed to the winning Members.
A cash progressive jackpot Member Game is open to as many Members as wish to participate up to a certain time specified by us, and the prize associated with the Member Game will increase as the number of Members admitted to the Member Game increases.
Cash prizes will be deposited directly into a winning Member's Paypal Account and will usually be available within thirty (30) minutes of Member Game’s conclusion. Where a Member Game ends before its scheduled closing, the prize for the Member Game will be reduced to reflect the proportion borne by (a) the number of Members participating in the Member Game when it closes, to (b) the maximum number of participating Members intended for that Member Game.
Game rules, scoring, controls and guidelines for all tournaments offered by us can be found at each specific Game section. Any questions or comments regarding this information should be sent to our Customer Support, the details of which are located on our Contact Us page.
At the conclusion of each Member Game, we will list the usernames and scores of the winners. The lists will only be available to the Members participating in the Member Games. We will also regularly update the site's various high scorer tables. For Member Games with substantial prizes the Member Game conclusion and posting of winners may be delayed for up to 5 working days by us to allow for verification of result and prevention of abuse.
UPLOADING MATERIAL TO OUR SITE
Whenever you make use of a feature that allows you to upload material to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy. You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty.
Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.
We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.
We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out in our Acceptable Use Policy. However, each user acknowledges that we do not actively monitor material uploaded to the site, and we make no undertaking to do so.
Further to the above, all material uploaded to the site, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such material originated. We do not control material posted on our site in relation to the Games by third parties, and as such, cannot guarantee the accuracy, integrity or quality of such material.
You understand that by using our site and the Games, you may be exposed to material that you may consider to be offensive, indecent or objectionable. We will not be liable in any way for any such material including, but not limited to any errors or omissions in any such material, or any loss or damage of any kind incurred as a result of the use of any such material posted, emailed, transmitted or otherwise made available in relation to the Games.
ACCOUNTS
A Member may open only one online Account and one mobile Account, which must be funded only by that person. We reserve the right to assess compliance with this requirement by checking for unique email addresses, real world addresses, credit card number and/or any other payment forms used to establish an Account.
If you provide materially misleading, inaccurate or incomplete information in your Account, we will be entitled to terminate your Account and cause you to forfeit any prizes you may have won as well as exercise any legal remedies we may have as a result of such conduct.
If any Member is discovered to have more than one online Account and one mobile Account, we reserve the right to close any additional Accounts and consolidate the funds in such additional Accounts into the original Account.
The maximum funds transferred, if any, will not exceed the total amount of deposits, less any withdrawal requests that have been paid on the additional Accounts. All winnings shall be forfeited. We shall also have the right to deduct the reasonable costs of doing this from the amounts being transferred to the original Account.
By opening an Account, you agree to allow us access to your Account to investigate complaints and/or other allegations of abuse.
Continued breach may, at our discretion, result in the termination of all the relevant persons Accounts and banning from the Games and the Member Games.
When you request your first withdrawal from your Account, we will ask you for (a) proof of your identity and (b) your email address. If you are unable to provide this to us, to our reasonable satisfaction we may be unable to pay your requested withdrawal to you. We reserve the right to request this information for subsequent withdrawals too.
Where we have a serious and reasonable suspicion of fraudulent activity on an Account, we reserve the right to withhold the payment of withdrawable funds to a Member until the end of the charge-back period which applies to the payment method used to pay in the relevant funds.
We will not be liable to you for any loss that you may incur as a result of an unauthorised person accessing your Account and we accept no liability resulting from its unauthorised use, whether fraudulent or otherwise.
Any amounts that are mistakenly credited as winnings to your Account remain our property and will automatically be transferred from your Account upon the error being noticed. Any winnings mistakenly credited to your Account yet withdrawn by you will constitute a debt owed by you to us in the amount of such wrongfully attributed winnings.
We reserve the right to refuse to accept any promotional offers that we make to you and to withdraw them at any time. Any promotional offer that we make is subject to change by us at any time. Any additional terms and conditions that apply to a promotional offer will be displayed beneath it. By accepting a promotional offer and/or making use of a promotional offer, you are confirming that you agree to its terms and conditions.
FEES
There are standard fees for all cash Accounts as follows: Playing fee: Approximately 30% of the entry cost for a Cash or progressive jackpot Member Game represents a fee paid by you to us for hosting the Member Game. The remaining 70% of the entry cost is not paid to us, but goes into the prize fund to be paid by players to the winner(s) of the Member Games.
Withdrawal Fee: Each withdrawal from your Account will incur a processing fee of up to £2 per request. If an Account balance (excluding any non-withdrawable funds) is lower than the withdrawal processing fee, the withdrawal request will not be completed.
When you credit your mobile Account with funds, the amount credited will be worth less than the amount that you paid. This is because you are charged a small transaction cost for making a deposit. The amount charged will be stated before you make payment.
QUESTIONS AND ANSWERS
QuizFortune Limited will not be liable in respect of any claims, allegations or queries with respect to the authenticity or correctness of any questions and answers for the questions asked in the Games (including the Member Games) on the website. QuizFortune Limited’s decision on the correctness or incorrectness of any answer is final and binding on all users and Members. In the event of any fault, misunderstanding or dispute concerning any part of the playing of the Games, declaration of the winners of prizes, the operation of the services of the website, and/or the validity of any question or answer options, the decision of QuizFortune Limited shall be final and binding on all users and Members.
PROHIBITED ACTIVITY
You agree not to:
- upload, post, email, transmit or otherwise make available any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
- use the Games to harm minors in any way;
- use the Games to impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;
- remove any proprietary notices from our site;
- cause, permit or authorise the modification, creation of derivative works, or translation of the Games without our prior express written permission;
- use the Games for any commercial purpose or the benefit of any third party or any manner not permitted by the licenses granted in these Terms of Use;
- use the Games for fraudulent or abusive purposes;
- attempt to decompile, reverse engineer, disassemble or hack the Games, or to defeat or overcome any encryption technology or security measures implemented by us with respect to the Games and/or data transmitted, processed or stored by us;
- harvest or collect any information about or regarding other Members or Members’ Accounts, including, but not limited to any personal information;
- upload, post, email, transmit or otherwise make available any material that you do not have a right to make available under any law or under contractual or fiduciary relationships;
- upload, post, email, transmit or otherwise make available any material that infringes any patent, trademark, trade secret, copyright or other intellectual property rights of any party or that is personal, confidential or sensitive information about, or belonging to any party;
- upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes”, or any other form of solicitation;
- use our services for phishing scams;
- drive traffic from our website to pornography, illegal or unlawful sites, including sites that contains nudity or sexually explicit material;
- facilitate gambling, online or otherwise, including betting or lotteries;
- upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- access another user’s account without their permission;
- act in a manner that negatively affects other users' ability to compete in Games or engage in real time exchanges;
- interfere with or disrupt the Games or servers or networks connected to the Games, or disobey any requirements, procedures, policies or regulations of networks connected to the Games;
- use the Games to intentionally or unintentionally violate any applicable local, state, national or international law, and any regulations having the force of law; and/or
- use the Games to harass another.
VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.
SUSPENSION OR TERMINATION
We reserve the right to either suspend or terminate any Member’s access to the Games, or the Member Games, and to forfeit from such Member’s Account(s) all winnings, if such Member or material is deemed by us to be in breach of these Terms of Use. Any person whose access has been suspended or terminated must not re-register for, or re-access, the Games without our prior written consent. You are responsible for all actions on your Account while you are logged in.
At the termination of an Account (whether by us or you), a sum equal to the remaining amount of funds that may be withdrawn in the Account will be returned to you once you have (a) proved your identity and (b) confirmed your email address to us, to our reasonable satisfaction. Deposits of funds made in the Account, less any withdrawals that have been made on the Account, will only be credited to a PayPal account that is registered in your name.
RECLAIMING/WITHHOLDING OF PRIZES
QuizFortune Limited may refuse to pay the jackpot prize money or reclaim the prize money awarded to any winner of any prize money in the event of his/her fraud, dishonesty or non-entitlement to participate in the Member Games under these Terms of Use. If at any time, including after disbursement of jackpot prize money, any information submitted by the member is found to be incorrect, false, or otherwise misrepresented or misleading, the member(s) shall be liable to refund all amounts received from our site, together with added penalty and interest as deemed fit by QuizFortune Limited. QuizFortune Limited reserves the right to initiate legal proceedings, if it deems fit, against any such Member(s) who is found to be violating any and all rules of the game and its Terms of Use.
LOCAL LAWS
It is your responsibility to ensure that national, state or other laws to which you are subject to do not adversely affect your right to participate in or play the Member Games.
You must comply with the laws which apply to you in the location you access the Games from. If any laws applicable to you restrict or prohibit your participation in the Games or the Member Games, then you must comply with such restrictions or prohibitions.
We may monitor the location from which access our site and, may use techniques which are intended to block access from any location in which participation in the Member Games may be illegal or restricted as we may determine from time to time.
We may require a Member receiving any prize to provide proof that he or she is eligible to participate and if we determine in our sole and absolute discretion that you are not eligible, we may refuse to award the prize.
If you live in the states of Alaska, Arizona, Arkansas, Connecticut, Delaware, Florida, Illinois, Iowa, Louisiana, Maryland, Missouri, Montana, South Carolina, South Dakota, Tennessee or Vermont, you are not eligible to play Member Games.
LINKS FROM OUR SITE
Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
INDEMNITY
You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of these Terms of Use by you or any person to whom you have allowed access to your Account in breach of these Terms of Use or through any computer that you use to access the Games.
ASSIGNMENT
We reserve the right to assign ownership of this website and these Terms of Use and to assign or subcontract any or all of our rights and obligations under these Terms of Use. You may not without our written consent assign or dispose of your Account or assign or subcontract any of your rights and obligations under these Terms of Use.
DISCLAIMER
To the maximum extent permissible under applicable law, in no event shall we be liable, whether in contract, warranty, tort or otherwise for any indirect, incidental, special or consequential damages arising out of the use (or inability to use) our site or the Games, including any damages resulting therefrom, even if we have been advised of the possibility of such damages.
JURISDICTION AND APPLICABLE LAW
The courts of Northern Ireland will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. CREDIT CARD INFORMATION
